Digital Marketing - Terms & Conditions

These Terms of Service (this “Agreement”, “Terms”) are entered into between The Front Digital Pty Ltd. (“we”, “us”, “Developer” or “Contractor”) and the Client (“you”, “User” or “Customer”) engaging our services (“Services” or “Service”). Our Services include—but are not limited to—website design and development, content management, on-page and off-page SEO, local SEO, Google My Business optimization, Google Map citations, social media marketing, hosting solutions, and domain management.

The following terms and conditions outline the use of our professional services. These terms are essential to establish clear expectations, ensure quality service delivery, and protect both parties.

What Digital Marketing Services do we provide?

We offer professional digital marketing services including On-Page SEO, Off-Page SEO, Local SEO, Google My Business management, Google Map Citations, Social Media Marketing, Content Strategy, and related analytics services.

What is the scope of work?

The scope of work covers the specific digital marketing services requested by the Client, outlined in the Scope of Work document. This includes deliverables, timelines, and terms for SEO campaigns, social media strategies, listing optimisations, and performance tracking. The scope may be revised with mutual agreement in writing between the Client and The Front Digital Pty Ltd.

What assets and access must be provided by the client?

The Client must provide timely access to platforms, profiles, and content resources necessary for executing the marketing strategies. If the Client cannot provide them, the Developer may create or procure them at an additional cost. The Developer is not liable for delays caused by missing inputs.

Access to Digital Platforms

The Client must provide admin-level access to their Google Business Profile, website CMS, social media accounts, analytics dashboards, and any other relevant platforms.

Branding and Media Assets

The Client will provide brand guidelines, logo files, image libraries, and any video content required for campaigns.

Business Information and Offerings

Accurate business descriptions, service listings, target keywords, and geo-locations must be provided to enable Local SEO and citation building.

Marketing Channels and Platforms

Our services span across several marketing channels and tools based on strategy suitability. While we make recommendations, final selection and access rights rest with the Client.

SEO Tools and Web Analytics

We use tools like Google Search Console, SEMrush, Ahrefs, and Google Analytics for SEO and performance tracking. Client access will be set up where applicable.

Social Media Platforms

Marketing activities may be performed on Facebook, Instagram, LinkedIn, or other platforms depending on audience targeting. Clients are expected to provide admin access or approve ad accounts as needed.

Google My Business & Map Citations

We optimise and maintain your Google Business Profile and build location-based citations. Any verification steps must be completed promptly by the Client.

Performance, Reporting and Review

The Client will receive periodic performance reports that include campaign outcomes, metrics, and recommendations. All campaigns are reviewed at agreed intervals to align with the Client’s goals.

Monthly Reports

Clients will receive a detailed report on SEO performance, keyword rankings, backlink health, ad metrics, and engagement insights.

Review and Feedback

Clients are encouraged to provide feedback within 3 business days of receiving reports. Adjustments and new strategy proposals will follow during review discussions.

Service Agreement Cancellation

This Service Agreement for digital marketing services may be cancelled by either party with thirty (30) days written notice.

Refund Policy on Cancellation

If the Client cancels, they will be billed for work completed up to the date of notice, including content, ad spend, or tools purchased. No refunds are issued for completed strategy execution or third-party costs.

Example Scenario

If a Client cancels after the SEO campaign has begun and citation listings have been submitted, the Client will be charged for time and resource investment up to that point, even if full campaign duration isn’t completed.

Content and Creative Usage Rights

All marketing content created for the campaign belongs to the Client. However, the Developer may use campaign results or designs as part of its portfolio unless agreed otherwise in writing.

Client Ownership

All content created during the campaign (e.g., posts, graphics, meta descriptions) is owned by the Client upon full payment.

Developer Portfolio Use

The Developer reserves the right to showcase creative work or performance results as case studies unless explicitly restricted by the Client.

Technology and Tools Disclaimer

We may use licensed or third-party tools for campaign delivery and analytics. While we ensure quality, we are not liable for outages or issues related to external platforms.

Tool Usage

We use both proprietary and third-party tools to manage marketing efforts. Access to these tools may be limited to internal use unless agreed otherwise.

Platform Changes

We are not responsible for sudden policy changes or restrictions introduced by platforms like Google or Meta that may affect campaign performance.
